Husband faces intoxication manslaughter after wife dies in crash

Deputies arrested a 49-year-old man on Tuesday after he killed his wife in an alleged drunk driving crash on a rural road in San Antonio. Carl Lee Morrison was charged with intoxication manslaughter. In the state of Texas intoxication manslaughter is the charge a person receives for causing a fatal motor vehicle accident while driving under the influence of drugs or alcohol. A preliminary report from the Sheriff's department puts Morrison and his wife traveling eastbound in separate vehicles. A few miles later it seems like Marlena Morrison made a quick U-turn, and as she was rounding the corner, her husband’s pickup truck slammed into the side of her sedan. When paramedics arrived, they pronounced Marlena dead at the scene.


In the context of an intoxication manslaughter case, driving while under the influence qualifies as criminal negligence. The resulting death is considered a crime regardless of the intent of the perpetrator. Under Texas criminal law, the charge of intoxication manslaughter is a second-degree felony. A conviction can carry the following punishments:

  • A 2-20 year prison sentence
  • Possible fine of up to $10,000
  • Serve at least 240 hours of community service
  • Possibility of an additional 800 hours to be used at the state’s discretion

One death from drunk driving is one too many. The law requires proof that the driver was actually driving while intoxicated and as a result of that, directly responsible for the death of the other individual.
